Q: new non-criminal background check required for visa.

Felonies v. Misdemeanor/infractions, agency = state or local.

 

What are your experiences?  Were you denied?

I have looked online to find answers on consulate pages and elsewhere and have found no clear info.

 

I found a question on here but is dealing with where to get in uk.  I'm more interested in specifics of what is allowed and what isn't.

hi, we are visa agent, but not handle this part, the following for your reference.

 

 

 

the step by step procedure in obtaining Police Clearance (Notary Certificate of No Criminal Conviction).

 

1, apply no crimal conviction paper from your home and transfer to Chinese
2, get the authentication paper by China embassy there.
3, apply the no crimial conviction paper to police station in china community you live.
4, get notary paper by the notary office in china.

Thanks, but not really  what i asked.  The steps involved are listed on consulate website.  

 

Must it be national finger print search, or can use a local (county-level) that I most recently resided in back in USA(home country) opposed to doing a State(province) search?  Also what is considered no conviction (felony/misdemeanor/infraction)?

Depends on what you got convicted for?   would say Child Molestors,  Demestic battery, abusing children, assualts and batteries probally not.     Speeding tickets,  reckless driving, DUI convictions if a long time ago probally can.   I would venture to say most of them probally dont know the UK or US laws.   They dont know the difference between felonies or misdeminors.     Your best bet is to just get the stupid criminal background check and just give it a try.     I would say if you have  a conviction  and it was a long time ago dont get the fingerprint record.   Best bet is to find the city where you are applying for the work permit and just ask them what are your requirements for the criminal background check ask them to be very specific because its takes a long time to get it from your home country.      I really dont know the answer it depends which city you go to  and which officer handles your case.

You can try this also.  If your conviction was like at least 5 years ago or more.  Go to your local police or country courthouse and ask them to print you your records for the number of years prior to your last conviction.  Tell them to ommit anything beyond those years because you dont want any to give these hypercrites and thing with convictions.  They are a bunch of discriminating racial biggots.   They themselves break the laws everyday and so do their own citizens but they can work.     Lets say you was convicted of a DUI 10 years ago.  In America it will show up your finger print background check.   Try this go your local courthouse and say I need a background check for work but I only want to go back 10 years.   See if they will allow you to do this.   I think they will because you are reequesting it for yourself.     Than see if the goverment here will accept it.   However, I do believe at least in Shenzhen they must have some kind of seal on it.   However, the local county courts provide that seal, make sure it has the seal on it.  Tell them they must put the seal on it.     Now the bad news,   if they really want to be maticulous and thourougly check out your past.    It not difficult for any company to find out every  thing you did because all they have to do is find out what county or state you lived in and they can find many of your past convictions, court dates,   bla bla bla.   My friend was able to show me all mine.     All of mine were just traffic offenses and the DUI but it just goes to show you if they really want to dig they can find just about anything even if you get it sealed or expunged by a court order.    Hope this helps.   Just give it a try.

外国人在中国如何办理无犯罪记录证明

一、在本人所属国办理无犯罪记录公证,证明其在本国居住期间无刑事犯罪记录,并同时附中文译本;

二、持上述公证书到其所属国外交部授权机构、以及中国驻该国领事馆认证;

三、到其在中国居留期间居住地派出所,出具无犯罪记录证明;

四、持该证明到公证处办理在中国居留期间无犯罪记录的公证。

五、持经过认证的外国公证文书和中国公证处的公证书,就可以办理有关事项。

The problem is that no one, including the government knows what the policies are.

 

I have been trying to get a straight answer out of them since July. Do I need this CRB, or can I just renew my Residence Permit? It seems like in Beijing and Qingdao this is possible, in Kunming, they want one for renewal. However, again, I have heard yes you must have it upon renewal and no, it is only for new applicants. Even for Beijing, I have heard both.

 

My city does not seem to know. I have heard that the CRB is for new applicants only. I have had a police officer in the Entry Exit saying that it was not required. Problem is that in my mind, they are still working under the "old system" no fingerprint machines and all that jazz. When I called, the turnaround time has been upped to 15 days, but again, the finality of the CRB (according to the girl on the phone) has not been decided yet. Again, the hair pulling problem is that I don't think they even know.

. A guy that I know here just got his renewal back the other day no problems. 

 

At least in my city it is difficult to get a straight answer, and although my city has announced the CRB, Again, they do not know if it will be required for everyone or just first timers.

 

Federal, state or local is also seemingly a tossup. According to Law and Border, Beijing will accept almost anything, while in Qingdao, it should be FBI/national......BUT AGAIN......I have read on this very board that Qingdao will accept a state or local. Very confusing to say the least.

 

Some dude on Reditt claims to have gotten a Permanant Residence Permit with a LOCAL background check., in Beijing. He set up a link to his story on getting it, and he claims Beijing took it. Look at the link and there is another link with what the guy gave the government.

sHHHHHHHHHHHHH!  keep qiet dont say your friend was able to get clearance in Beijing with just a local CBD too many times or those the FEC might get wind of it and change it again.  LOL

 To answer the persons above question.  No I have not been able to get it because the last school I was with didnt want to try because I refused to fly back to America this July and PAY FOR MY FLIGHT just to get a stinking Z VISA!  So they just said I had DUI probally as an excuse.   I have heard other people in Shenzhen recently have been able to do it with DUI conviction on record.  Depends who you  know and if there in a good or pissy mood.
