Q: Obtaining the release a month earlier but still fulfilling the contract

Hi everyone,

 

I've found a job in a different province which would be happy to provide a Z visa for me.

My contract with the current company expires in 1 month  ( and I have no problems with finishing it) while my residence permit expires in nearly 2 months. All is well but my new company asked me to obtain the release letter from the current company ASAP as they're afraid there won't be enough time to switch me from one Z visa to another without having me to leave for my home country and reapplying for the visa there.

I have good relationship with my curreT employer but she is worried about the police would find out I'm finishing my last month illegally. She dug her heels in and won't give in.

Its a bit expensive and time-consuming e to go back to my home country. Any good ideas of how I could convince her? 

 

Would be grateful for any suggestions!

Ask your new employer to talk to your present School. For RP extension you can use any (old) Release letter you have.

 

I break my Contract with Dalian Training School in April, 2013 with 30 days Resignation notice. In the same time, I signed new Contract with School in Xinjiang. New employer asked me for Release letter and FEC cancelation certificate.

I asked School in Dalian for documents, but they kept me on 'promises' for 30 days. I also advice my new employer to speak to School in Dalian, and explain them urgency for documents. 

I left Dalian without documents. At my arrival to Xinjiang, I gave my new employer 'edit': Recommendation letter from my Dalian part-time job. Everything was fine with the 'Release letter'. I am sure, I could also pass with an old RL.

Problem was with FEC cancelation certificate. I contacted Dalian FEB, and I complained about the School. 

My RP expired on June 30, 2013. I received Release letter, FEC cancelation cert. and another letter in Chinese on June 29th, 2013 from Dalian Training center. Dalian School wasn't happy, I break the Contract, so they stall with everything. However, School in Xinjiang successfully extended (overnight) RP on time.

 

You could find reliable information about your problem at FEB (SAFEA). I heard that by Chinese Law, your old employer must give you all documents in 30 days after you finish working for them. SAFEA will help you get documents earlier, if they it find necessary.

Disregard any advice about using old release letters and trying to cheat the system. If you contact SAFEA, tell them the truth about the matter, and they will possibly advise your current employer that it is OK. If not, you are best to wait, even if it means spending some time in your home country. The alternative is to find another country to work in.

 

Unless you are 100% legal (degree, CELTA, 2 years working experience, valid and legal RP) keep right away from SAFEA. There are some posters on internet forums who give you advice that will simply lead to you reporting yourself as an illegal worker or a trouble maker.

im 100% legal, so I guess I'll try to contact SAFEA and see if they can help.
