Q: overstay and resedince permit (z visa)

I got Z visa, and it is about to expire in 3 days. My employer says that paperwork will be done in a few days after the expiration date, but I'll still be able to apply for residence permit having 1 or 2 days of overstay. Is that right? What kinds of problems can I face?

Thank you.

If your company can get the paper work and your passport handed over to the PSB before 3 days you're safe. If not you need to request an extension and get a company stamped letter with an explanation on it and a company stamp.

ScotsAlan:

Yes. You have 30 days to apply for your RP. Once you have applied you are ok, irrespective of how long it takes to process. Once you have applied you will get a passport receipt. However, you need your medical results etc to apply.

Your Z visa is good only for 30 days, and allows you only to enter China.

Once you enter, must obtain your Work Permit, FEC and temporary Residence Permit. This TRP takes over and works like a visa, and it is given by PSB. Now, is the visa or the permit expiring? If the visa expires, and your permit is still good until end of contract, then no problems. But if the one expiring is the TRP, go to PSB and explain the problem before expiration (that is a must), and they can give you a 10 day L visa to get the papers.
Hope this explanation helps you, but bear in mind that in China, no two cities do things the same way.

I don't know if it is the same with the Z visa as  it is with the Resident permit (and each city is different) but the paperwork needs to be handed in to the PSB before or on the day of your expiration. You are responsible for this because you are the one who will have to pay the fines. be careful of what schools say because they are liars and just plain dumb. You should do as the above posters said and go to the PSB. I was screwed and had to leave the country last minute because a school put me in the same situation you're in.

Alright guys, thank you so much for your help. Now I at least know what to do. Thank you so much.

Shining_brow:

You also need to yell at your HR department! There is NO good reason why the paperwork shouldn't already have been done! (no, holidays are not an excuse! Because, there is this thing called 'preparation').

well.. others may disagree with me but I am speaking according to my experience.. if your TRP is expiring and you are only going to renew it (and do not intend to leave China at present) you will have no problem in renewing it even after a few days of expiry. As i said earlier I am saying this according to the experience.. but as Happy said "no two cities do things the same way."

My HR did the FEC extension application two months in advance, I was worried that I might loose few days in the process, but It didn't happen. The new term in the brown book started right after the old one expired, now for extending the RP on the Passport... I went with the HR to the local gov office... they gave me the passport pick up date 20 days after submission which was 2 days after the RP expires. It was no problem.

From your question if the Z visa/brown/blue book extension is still pending then that could be a problem, because it was all done after plenty of pestering emails to the HR lady and also long long time.

Do let us know what happened next though.
