Q: Q visa problem

Hi

i have a short term two year Q visa. The maximum stay is 120 days each time. The first 120 days was no issue but the second 120 days I encountered a problem and couldn’t leave until 12 days over. My daughter became sick and I couldn’t leave until knowing she was ok and home. I tried to leave the country as soon as possible and once I got through to immigration there was obviously a problem. They told me to pay the maximum fine. I told them I couldn’t as I had just been paying hospital bills and it was too much for me. They then wouldn’t allow me to take the flight so I had to leave the airport and go back to my current city in Shandong. I am unsure as of the next steps I should take. Advice welcomed please and thank you.

You need to go to the main PSB station of where you got and picked up your visa or 2 year resident permit at and bring the bills and explain your case, all bills from the hospital will have dates to prove the case. That might work.

 

If we would had been friends at that time I would have been yelling you down saying: You gotta pay for a babysitter! China doesn't forgive late visa exits easily..

 

So as of now you are on day 12,13 or day 14 illegally in the country still with a fine of 5000 or 10,000 RMB waiting for you?

 

Its sad to say man, but if you can't get your case cleared at the PSB station where the visa's come from than I'm afriad you'll have to pay the fine and than you'll be banned 2 or 5 years from entering China, meaning you're 90% at being blacklisted if not already.

 

Go to the PSB and always remember China usually never forgives late exits.

BTW, where's or what is the Chinese spouse doing while you are going through a possible goodbye from China, I'm sorry I blame your Chinese spouse for not making sure you had the time to exit and enter correctly, where are the inlaws?.

The time just got away from me. I got the visa issued in London I haven’t been to a psb in the time I’ve been here as it’s only short term.

Just to update you, after you get a 2 year Q visa even with 120 day exits, you were meant to take that Q visa to the PSB and get it converted into Resident Permit and that way it could have been renewed within the Country, than no exits needed, the Q visa is almost like a Z visa meaning it just gives you a reason to enter the country, your case "family", depending on the visit case its always best to get the Q visa converted into a Resident Permit.

 

So again:

 

1. Go to the PSB and get it fixed (if they will) and than ask them to convert it to resident permit.

 

2. I'm not saying but just guessing that you're working undercover on a Q, so you'll have to save up for that fine and pay it, the fact that you've already reached the max means only jail for 15 days would come next and I never seen any western guy jailed for 15 days, so staying or working undercover to get the money you need won't hurt because the max fine is already there.

 

3. A lawyer could save your butt in this case, but that would be pricey.

 

If you find away to get out of this mess, than move your family to Shenzhen, Dongguan, Guangzhou or Huizhou and message me and I can set you up for jobs, all my contacts have good job offers even undercover guys are working for them.

 

Why move here? Because the Hong Kong Border is here, you'll save time and money.

There are two ways, Q1 or Q2 can be converted into a Family Resident Permit visa thus you don't have to exit on it very 60 to 120 days, just keep renewing it. Like a working resident permit states: Purpose: Work / This resident Permit would state: Family. Now if you wanna go the "exit 120 days" route is all up to the visa holder, its not wise.

 

The old former L-Family visa didn't give us a resident visa. But Q's can be converted, a while back I took 1 year off from work to help my wife with our new baby and used a Q2 and got it converted into a 3 year resident permit, they gave me 3 years at the PSB and I didn't ask for it but that was nice, after a year I went to HK for a new Z visa and starting working again.

Foreigners need to understand that they're not in their home countries. Any civilized country would look at your evidence and then issue an exception based on family emergency. 

Follow Iron Man's advice and good luck.

 

Additional notes to anyone else living in China:

China is a country you work in not live in (unless you're wealthy) because BS like this will happen. And for all those with children, have good health insurance or go back to live in your home country, you don't want to end up in a situation where your kid needs serious medical care in China.

Understand what China is

Agreed, as long as I've been here I can never get that "I'm at home" feeling, my wife ripped me a new a** for getting a mortgage for a house back in Ohio and my reply is always: What IF I have to leave for whatever reason? We never know.

Yeah I was totally uneasy so I gave the mortgage to my wife and said you want it, it's yours and I did the same in the U.S. as a backup. BTW you'll probably see the story if the Chinese man who got deported in the U.S. after ICE gotta him, 2nd story like this..

I have to wait until I can get the money together before going to the psb. Once I get it, I will explain the situation, show them I tried to exit twice and I’ll pay the fine. Hopefully they cancel my current visa l, give me a short term visa and don’t blacklist me. Then I can go HK and get a new visa. That’s what I’m praying for.

I would make plan A: How to make it work back home, I mean your home country, job wise, new life new start, and or if you have a degree and qualified to work in Taiwan or Hong Kong than go there to work. It doesn't sound like your qualifications are ready for Korea as they are similar to China's. Plan B: The PSB forgives you, life goes on. Yeah 500 a day, the limit is 5000-20000. I'm gonna ask this again: Where is your wife? She is Chinese and could easily walk into the PSB and talk about your case with them nothing would happen to you, just tell the wife to go to the PSB that does the Visa's for foreigners and talk about the case.. We're worried if you wait than nothing can or will be forgiven, I feel it's best to surrender now, or let your wife save the day.

So it's almost a month overstay by now? Dude, you need to get in front of this.

Obviously there is some issue with your wife or you would have gone with her to sort it out. The longer you leave it the worse the consequences. The last thing you want is to get slapped with a 5 year ban. Immigration authorities are not known for being understanding about overstays. I know money is tight but you should talk to a lawyer.

Methinks there is more to this story than is being told.

Agreed, no matter what problem you and your wife might be having she doesn't want the father of her daughter to get into this much trouble, well I can't imagine some reasons why she would, but that's not our business to assume anything. If you can't ask her ask a friend to walk in and ask for you, it's that simple.

Any updates? I am having the same problem, at this moment I am struggling whether to go back to Australia to to it or do it in Hong Kong, I heard people say that once you have the * on your passport you will not be able to to it in Hong Kong:(

Once, your passport is marked because of overstay or other immigration violations, I'd say you'll have problems at new visa issue anywhere you go.

 

However, I've never experience that. I am using (my) common sense.

 

I exited China once some 10 hours into no-more-RP-day, and I was separated and placed into small office for 2-hours sit-down. She-Border-cop gave me stark warning: 'Don't do it again!'

I was late at exit because plane in Tianjin had 10-hours delay at departure. My excuse why I am late at exit wasn't 'I-had-flat-tire' excuse, but cop was able to check what I said ...

After that, I've never exited China on my last visa/RP day.

Cops at Luohu take laowai's offenses very serious as it is disrespect toward Chinese laws.

I have been thinking to apply for a new visa in Hong Kong but not yet decided, sounds like I wil have to go back to Australia. I have checked with all connections I have at the PSB and they say I am not on the blacklist.

If you are close to HK, stop&try with visa in HK. You can fly home out of HK, too.

 

Maybe, you should ask for an opinion on HK-visa pick-up from Visa agents.

 

Yahoo-gle 'Foreverbright HK visa' and ask them for a possibility of HK visa pick-up through 'Contact Us' on their website.

Simple answer if he hasn't replied:

80% ~1. He solved it, he's fine and forgot to reply because he's doing the nasty to celebrate. Most people never reply to us if they solved it, if they failed they comeback to spill their guts and sadness here.

60% ~ 2. He's still working and gathering up money to buy his way out.

20% ~ 3. He's in immigration waiting deportation or has been fined & kicked out nicely.

No more 150 people queue in Wanchai ... Embassies around the world implement the same measure: either they ask for state ID (BG, near Schengen) or other BS (state issued Bank account and Med. Insurance) as in Romania. 

The shortest and cheapest way I'll ask for the next Russo visa will be in me-passport-issuer-country. i.e. home.

@diver: I guess, less takers requires higher price. They'll advise for free if you show an urge&intent .... talkin' to a real cheapo, here ...

haha,,, I burned them for some advice myself.... but wound up buying one of those 1000hkd visas,,, I forget it's official designation,,, lol,,,, but then changed it in for a proper 'live in chiner visa' for just another 300,,,  foreverbright delivers,,, they are the last place that cares about and respects  ¥ & guanxi.   good on 'em!
