Q: rents in shanghai

what is happening with rents in shanghai?why are agency asking foreigners to look for replacement before leaving their apartment or the will lose their deposite? are foreigners suppose to look for tenants in china?

This doesn't sound right, unless you are leaving before the end of your contract. In that case I'd say it's fair enough.

 

But if your contract is ending and it doesn't say you have to find a replacement in the contract then stand you ground. Go down to the office with a Chinese person (even if you speak Chinese a Chinese person will help) and demand your deposit. More often than not they are just looking to make a quick buck from what they consider a stupid foreigner. Start making a fuss and it quickly becomes not worth their while.

I've only ever seen this happen if you want to break the contract part way through. Why? Because the owner will have previous paid out half of the agents fee to rent the place originally and quite rightly shouldn't have to pay it out again until the contract is up.

 

So you should not need to do this if your contract is coming to an end. You should have to do it if you want to break your contract early.

They do this for shared apartment.When you want to rent a share apartment, they will tell you to deposit 2 months of rent.I was told that if i am not able to find a replacement i will not get back my deposit

Now is it the agency asking this or the person in the apartment who has signed the lease contract? If you share with others you all share the rent. If one then moves out early it means the others have to pay more rent until a replacement is found. So I can understand this requirement. 

 

What at can you do? Nothing! Accept it or rent your own place.

Sounds strange even for shared apartment.

With whom did you sing your contract? 

With the landlord and you rented just one room with the right to use common kitchen and bathroom? 

Shared apartments are usually rented as the full apartment and shared among friends.

Did the landlord signed the contract with one of you or with all of them.

In that case what is the wording of your contract?

Two monthly rentals as deposit is common in certain part of Shanghai. This does not sound like a problem.

If your contract is due and you gave the landlord enough noticing period, usually 15-30 days based on your contract, there's no reason they don't not give your deposit back, unless something's damaged.

You are omiting one very key point. Did you finish the term of your lease or are you leaving early. 

If you are finishing your lease term, they are just being typical lying, cheating, scamming trashy selves.

Legally, you might be able to call the police but if you're going to be pressed for time you're gonna have to get your hands dirty. Arrange to stay at a hotel  2 days prior to your last date on the lease. Move everything out of the apartment. Call the landlord telling him that you have a replacement so they should bring the deposit that is owed to you. Make sure you have an iron rod or something like that, you can figure the rest from here. Do this only if you are in the right and not breaking the lease.

Why are you talking to the agent? You rent the apartment from the landlord, agent only helps in finding an apartment. They collect their fee and disappear.

the agents renting shared apartments are the one asking people to look for a replacement before leaving the room.they will asked for one and the half month deposit or sometime 2 months and they will say that if a tenants cannot found a replacement, his or her deposit will not be given back.
