Q: Is School (Foreign entity) allowed to employ foreigners on F visa?

School I was working for, said I am in the breach of Contract. They claim, our Contract we signed few months ago is between me and Foreign Firm as educator in China. It is not Contract between me and Chinese Firm, so the Contract is valid, despite I was working 4 months with F visa.

 

Is that another bluff or valid point?

One thing puzzles me since I read it.  You claim your school claims you are in breach of contract because the contract was signed between you and a foreign firm, not the school ?   If so, I am also sure that the foreign firm had a contract with the school to supply teachers for a fee, so in any investigation, both should come to light.  Now, if it was legal for you to work under an "F" visa or not, that is another story.  Who paid you, the foreign firm abroad, the foreign firm in China, or the school in China directly to you ?.  If you were paid abroad, then was up to you to bring the money into China, you may have a chance to justify the F visa.  If you were paid here, by foreign firm or by school, you were in violation of law.

Now, again, I do not see why the school is raising this issue, do they wish to get rid of you ?

I do know a few ExPats who work for large corporations abroad, and who are in China either training employees or insuring their respective corporations that their instructions and procedures are being carried out to the letter.  they get their salaries and benefits paid abroad, deposit on a bank abroad, and from there thy transfer money into China.  They have successfully done this for years, without a hitch at all.  and all have renewed their F visas a few times each.

I told him, my 'lawyer' said, Contract is not valid because Firm made me work with F visa.

 

He is claiming, I will have problems to apply for Working permit and work for different School, because he applied already for my Working permit.

Hiring manager insist, I should sign new Contract with his School. He is  saying, I will have problems to work for another School.

 

His statement about Foreign Firm doesn't make no sense. I am sure it is just a bluff.

 

I received 5 salaries from Chinese Firm to my Chinese Bank account.

what is your choice? School handle your visa applications. I have never ask nobody to work with wrong visa.

Should I say, I won't work with F, if School says I will work with F 30 days only? Should I say, I want to go home, because I don't have proper visa in China! 

'30 days only' turned into 5 months! Now, I found new School, which promised everything by the book!

How do I know, will new School keep their promise?

You need a Z visa to work. F visa, you are working illegally and risk fine, deportation and return ban for up to ten years.  On the  pluss side, your employer ALSO faces a fine, UNLESS he has good guanxi.

What choice do you have? Refuse to work until you get the Z visa.

to anyone looking teach in china, do your homework. i'm an idoit  (i'm not going to fix it!) and i was quickly able to pull up the visa details and various scams schools run. i'm sorry i do not feel sorry for you. go to the psb, and tell them this BS story. they will sort it out.
