For successful law suit, you miss 'casus belli' ... i.e. 'causa', reason for damage or in other words even if your law suit would be accepted to proceed in Court of Law, judge would most likely end the proceedure with Q ''Why didn't you stay home .. in shade?"
You might be successful at suing Chinese gov. for the air you are breathing and lack of vitamin D 'cause you rarely get an exposure to sun ...'cause of constant fog and oveall environmental pollution result of quick industrialization in China.
