Q: Taken by the police

Hi there,

 

A bit of a story here to tell and I would like some suggestions what I should do in this case.

 

Yesterday I went to a hotel called "The Peninsula" to do a massage that I usually do at the hotel, I also use the hotel for other services as living, shopping and dining. After a shower and a rest I was led into the usual room with the massage therapist and he told me to sit down then he went outside the room. In comes three people that say that they come from the hotel, they just say that a crime has been comitted and that I am held accountable for this crime even though they don't have any evidence.

 

They told me that I had to go down to the police station and I was promised a translator but no one came with me. In the police station they started to scream at me that I should respect China and the Chinese people. I told them that I didnt do anything wrong and that I couldnt cooperate more than I was already doing. After a few hours a guy from the hotel comes and I know him and he speaks English. But he was told by the police that I he could not talk to me and that I could not talk to him. So he was taken inside a room with a lot of police and I really do not know what happened in there. Outside the police station the police just smoked and pointed and laughed at me.

 

After a few more hours I was subjected to more humiliation, after a while the translator that could not talk to me comes in to the room again and now he could talk to me and I ask him what I can do right now. He tells this to the police and some security manager and they say that I have to pay 15 000 to make it go away right now. I told them that I could not get the money now but the latest at Monday. They did not agree to this and decided to bring some special police with guns that took a few more hours.

 

When these police officers came they forced me into a small room without cameras where they wanted to me to sign a paper in chinese, which I of course refused to do. Then they told me to write in my own words what happened and sign that paper, so I wrote that a crime has been comitted but I do not know what crime and what I am being charged with. I also wrote that in this I am innocent and that no evidence is saying that I have done anything wrong. After that I sign the paper and they take it away from me, when they come back with the paper a thing has been added which says that if I do not pay them 15 000 before Tuesday, I am to abide the law of China. Then they let me go.

 

They have a copy of my passport and they know where I live. They have my telephone number as well. The Swedish embassy does not do anything in this subject, they say that I should get a chinese lawyer and fight this in China but that sounds pretty stupid if you ask me. What they are also saying is that I could go to the police station with someone working for the embassy and talk to them.

 

What is your opinions in this matter? I have until Monday to make any moves regarding this. So please help me with some relevant tips and if you have any questions then please ask them I am desperate for help!

Are you sure it was a police? To me it doesn't look like it was police. Double check, and don't pay anything!!

We have some leads to what has really happened and we are going to question them tomorrow. Cause of a tip on this website I really don't want to say more than that.

This is what happened today,

 

At 11 me and the Swedish Embassy went there, the police refused to ask any questions since they said that the embassy didnt follow protocol before coming there and it seems that they were right. The only information I could get from them was that the foreign affairs would be there later with a translator and then I could ask questions if I came by myself at 3 pm.

 

I showed up outside but there was no foreign affairs there, instead the Peninsula so I did not go inside, after a while someone calls me from the police and say they are from the PSB office and they say that if i do not appear I would feel the full force of the chinese law.

 

I did not go in there at this time since I did not feel safe but tomorrow I will meet with them myself with friends waiting outside to see what is happening. Any thoughts?

Did you hold your embassy accountable? Why didnt they follow protocol? And, are they just going to let you hang by yourself?

Seriously, I think  you now have two problems: The Police AND your Embassy.

Have you hired an attorney yet?

I have contacted a lawyer but I have to go in there by myself today, this morning. The embassy has now followed protocol but there is not much they can do as they cannot go. In to the polis station according to them and the police.

 

As for crime china, I have everything I said, my whole story recorded from the police station so I have proof that this all happening to me. For me being swede, well wtf I co tacked the Swedish. Embassy, did you think I was from africa?

fake or not, it is an interesting story and I wanna know the outcome.

 

For frederik, reading what you wrote, is seems like you're not the smartest guy.

How can you not demand and get an answer to the question why you have to pay the fine.

The protocol of the embassy stuff is very believable and no surprise. Most people working at embassies don't know the protocol and are just afraid to get burned and destroy their oh so amazing careers.

 

In the same situation I wouldn't pay a dime, but then again, maybe you did something wrong, even if you don't know it yourself.

 

Please keep us informed. Could you write more details?

Today I went in to the police station alone to talk to the police. They treated me very good and called me Sir and got a translator for me. They asked me why I was in the police station and they were angry that I didn't come a second time yesterday.

 

I apologized that I didn't come yesterday and they accepted that. The police then informed me that the Peninsula on Friday when they took me had said that I stole 15 000 from the hotel. So therefore I was brought into the police station. Now after investigation by the police they say that no crime has been committed and that I am innocent. The police wasn't presented with any evidence that I have stolen something and they have told the hotel this. The also said that they launched a bigger investigation but it also showed that I was innocence in all of this. 

 

While is was happening one of the police officers took pictures and filmed us and I also recorded the entire session with the police today.

 

So there you go, especially you (crimochina), you might not still believe me and my story might be strange but in the end I was taken wrongfully and the whole experience has been extremely humiliating for me. Thanks again for the people that helped me even thou some of you say that I am stupid.

The peninsula owes you an explanation BIG TIME ! It's a five star hotel, you can destroy their reputation and sue them for this kind of treatment (call the police with no proof), and destroy their reputation on traveller websites such as tripadvisor.

 

I highly suggest that you start doing that, they must give you at least, excuses, and then, compensation.

Weird outcome.  They apologised and filmed it?  And they said you were accused of stealing 15000 RMB?  That just seems weird.  I would get in touch with the management at the hotel and give them shit.  If it was me I would make it my life mission to ruin that hotel, or at least get adequate compensation.

Get a lawyer, let him deal with this type of problem. You shouldn't be trying to handle this on your own in a foreign country where you don't speak the language or understand the laws.

Two days ago i was on this forum through my mobile phone reading this and i did not understand the story "Did not believe what the heck am i reading" and i showed that to my GF and she told me that police station might be a bit involved in a deal with the hotel......and she said they don't know who stole the money "If there was money stolen".............That's why the hotel captured you cause you are a foreigner "You are the only one there who can pay that amount of money under threat of the police" and then the hotel made a deal with the police station to stick the case to you and the Police will get an amount of benefits from the hotel "Money or Hotel services"..........But seems like you gave them a hard time so the police just quit the deal and canceled the deal with the hotel since both of them know that you are not the one who stole anything and your are giving them a lot of diplomatic Light...................That is the case "If the story is true".........Best Regards to Missus Crea aka My GF

A posting on the blog of legal consultant Liu Xiaoyuan said the district commercial affairs department had informed Ai on Sunday that it was pulling the license of Fake Cultural Development Ltd. for failing to re-register. A copy of the department’s letter was posted to Liu’s blog.

That followed a court’s ruling on Thursday denying Ai’s appeal of a $2.4 million fine against the company for alleged tax evasion. Ai claims the charges were fabricated and won’t pay the $1.1 million balance on the fine, although authorities have confiscated the company’s legal documents.
