Q: Terrible Traffic Rule...

Normally i am satisfied with China.. but this one i recently encountered.. i am fully against..

 

Previously if a car hit electric bike.. Car insurance pays no matter its whose responsibility...

But its lil unfair to the insurance company considering the number of electric bikes involved in accidents (they are a big majorty cause of accident).. So recently i heard law changed and that the electric bike has to take responsibility as well based on law... i praised china for that... (most countries still car insurance has to pay full)

 

But actual situation - effect is opposite...

 

I had an accident.. full responsibility was the electric bike..my car got damaged as well..  And here it goes.. 

 

No matter whose responsibility

- cars insurance pays for all medical expenses of electric bike driver 100%

- cars insurance pays for electric bike repair 100%

- cars insurance pays salary for the electri bike driver - doctors normally writes off 3-4 weeks of rest even if no brocken bones/visible swelling.

 

BUT cars insurance wont pay for CAR REPAIR!! - This should be paid by the electric bike driver!!!!!

 

And in china electric bike drivers are poor and they just dont pay! 99.999% of cases.

police does nothing.

If Car driver insist to follow law.. he has to go to court against the electric bike driver.. It would take long time and will require you to go to court several times.. need pay for lawer... my accident happened in another city.. i must go to that city court..!!  The expenses will be much above actual claim .. expenses wont be reimbursed.. i ahve to pay from my pocket..

 

moreover due to dispute, my car remains in police station.. parking fee 150rmb per day or so.. insurance wont pay.. my responsibility...

 

WHAT A LAW!!!! Any comments??

Sounds about right for China, especially since you're a foreigner.  I just renewed by car insurance last week.  Still haven't had to use it.....yet.... *knock on wood*.

that is so much #$%^ i cant believe it i also drive and havnt been in any accident yet but the way these people drive its an adventure everyday if these people ever drove in the us the police would tow their car away and explaine idiots are not allowed on the road

UK is the same. I said to my wife if people who drive here had to take a UK driving test, even if they could read all the signs etc, 99.9999999% would fail. It amuses me when we are in the car with my brother in law, who by Chinese standards is pretty good, he complains about the idiots out there and then does things that in the UK would get points on the licence.

That is just one of many reasons I would never drive in China. Public transportation is so cheap, why risk it? Unless there is no other option, why not take the bus or a train?

 Do you think you are having a rough time ?.  I will relate an experience a relative of mine had a few years back, and I do know it is true.  I will omit name and places for obvious reasons.

He was told countless of times not to drive in China.  He paid no attention, bought a second hand car and started driving.  One day he stopped at a traffic light in red, two cars in front of him blocking his way anyway.  All of a sudden, a guy in a motorbike ram into my relative's car rear end, and the guy flew over his car, landed on the one in front, broke his neck and died.  Now, my relative under any criminal law was responsible, he was stopped at a red light.  But because he was a foreigner, he was thrown in jail and held for investigations of a possible homicide.  Things looked real bad for him.  There were very serious talks of him being brought to Court.

He finally gave in, paid a 10,000 Rmb bribe, was allowed to leave jail, went to airport directly and flew out.  And of course, he has never returned to China.

This is why I do drive an electrical bike, but will never have a car registered to my name or drive it here.  Drivers for car are cheap here, or let GF drive the car.

A very relevant story.  If the boss's best friend wasn't the local chief of police, I also would probably not be driving in China...

it was on the outskitts of a city, no rain, no fog, daytime. i was not aound, so i have no idea of bike speed, enough to throw driver over one car into the next in front. who knows, day dreaming, talking on cell phone, or in need on compensation, and something went wrong ........ it was a freak one, i do agree on that.
