Q: What happens after a messed up school cancels your work VISA ? Can you work again in China ?

To cancel a work visa, the employer physically needs to have it (and your Alien permit or Foreign Experts License).  As long as those items are in your possession, there isn't much they can really do except make threats unless they are REALLY @$$holes and get the police or PSB involved.

Your best bet is to go to the PSB and tell them you no longer work for the company and would like to explore China for a month or two and get them to convert it over to a tourist visa, or to quickly get a new job.  You WILL need a release letter from your old employer either way.

The only other option is to leave China and come back in on a new visa.

This is not true. I once worked at a school and there were three foreign teachers there. One of the teachers didn't come to work for three days. We tried calling him and emailing him but no response. After 2 weeks, the school went to the police and explained what happen and the police allowed them to cancel the work visa. The police said that the teacher should also sign the paper to cancel the visa but because he left the school with out contact, the police allowed the school just to sign. when it came time for payday, that teacher called and asked for his pay and of course the school said no because he broke the contract.

Most of what MrTibbles wrote is pure bullsh1t. :roll:

An employer can very easily cancel your work permit.

An employer can contact the Public Security Bureau and inform them that you are no longer an employee in their company and, as a result, your residence permit should be invalidated.

The PSB can cancel your residence permit without having physical possession of your passport. Many times, however, they will not go to the trouble of doing this, but they can if they want.

If the PSB does cancel your residence permit, it should not stop you from leaving the country. It may, however, result in your inability to return to China on the same residence permit. If you are in China without knowing that your residence permit has been canceled, nobody will usually hunt you down. However, when you find a new employer and attempt to obtain a new residence permit you will have issues and generally required to exit China before being able to apply for a new one.

An Alien Work Permit is a valid document until it has 2 holes punched through it or it expires in the time frame. The Z visa is in your passport. It needs a stamp across it that says "cancelled". I stated in m post that an employer CAN get the police and/or PSB involved. Here's something for you to read:

"Employers canceling the work permits of foreign employees must now fill out an official government application form entitled “Cancellation (Transferring) of Alien Employment Permit”. Although the form is bilingual, it must be completed in Chinese. The form must be signed by the foreigner who held the work permit, as well as be signed and stamped by the employer who sponsored the foreigner’s stay. Previously, no official form was required in order to cancel work permits."

So how can they cancel it "very easily" if it requires your signature?

A school can cancel a work visa with out the original visa (read previous posting, which happen in 2011). If the school can provide evidence and show that the employee broke the contract then the government can cancel the visa. This cancellation will be recorded in the computer so the next time the visa holder leave or comes back into china or apply for a new visa, it will show his old visa was canceled.

I think you both are confusing the residence permit (the visa like page in your passport) with the Alien Work Permit/Foreign Experts Certificate. The latter can easily be cancelled by your employer - they fill out a form (which at least in Shanghai requires you to sign as well) and pay a bit of money (300rmb I believe) to cancel it. It is IMPOSSIBLE to cancel a residence permit without having your passport. It's a visa. It simply states that you are allowed to work in China and only the government has the ability to do that, NOT an employer, and they physically need your passport to do so.

When I got my latest Residency Permit in October, the PSB gave me a form letter stating that the permit could be cancelled at any time by the employer without notification.

I read a post online once that a guy said the school cancelled his while he was still working for the school. Apparently their rationale was that they could then hold the fact that he was working illegally over his head if they ever wanted to. Obviously didn't consider the difficulties it would cause for them, knowing he was working illegally, but that's Chinese logic...
