Q: 'What would you?' or 'What should I do?'

 School here in Bijie, Guizhou, is run by scum-managers-owners!   I had problems with owners since after the first 3-months into the Contract. They made School's Board issue 'Termination of the Contract' for some bogus reasons ...   I nicely explained to them that if I passed probation period, I will most likely complete the Contract ….   I paid in advance for the dental procedure (120k Rmb), which is almost completed, but .... at the time I got Termination notice, the dentist was on approx. 1/3 of all work and it would be impossible to finish it in 30-days time.   So, I had to engage Chinese lawyer, who's only advising me for now.    School rep and all around him became very nice to me in the last 2 months of the Contract.    Today, I got new hit:   School rented apartment for 1-year and rent expires on May 18th, 2017.   Rep: ''Would you mind to move in the room on the Campus until June 10th (Contract's end!)?”… , when I plan to move to the new RP sponsor site.  Apartment's owner apparently doesn't want to extend rent for another 30-days, but only for the whole year, rep. told me.   I was in the Campus room at my arrival to the city (April 2016), because owner excused herself as 'I need more time to find an apartment’.  Campus room is without hot water in the shower and shared washing machine.   This request is Contract breach and I am not required to oblige, but in real they are just penny pinchers …    I almost made-up my mind and I won't move out and if I am required to vacate apartment on May 18th, I will get the room in Hotel in the city for a month until the end of the Contract.  Are these people for real?  I need a suggestion: 'How would you handle this request?'

Everything with RP transfer looks it will be OK: 1. I have signed and stamped Contract from new RP sponsor; 2. Rep here promised we'll do everything I described him we must do: 1. FEC Cancel cert; 2. Recommendation letter; 3. Release letter (I will get after I'll empty the apartment); 4. Last salary and flight bonus before I leave the city.

That was last week. Now today, they hit me with this .... I wasn't waiting for your replies/suggestions. I called rep and told him about Contract breach and if School will exist on vacating an apartment on May 18th, I will move to Hotel .... rep lost his cool and ..... screamed on the brick.

He isn't paid for this extra work, he has with me.

SAFEA, take your own advice

He is decent person, who runs the School and owner has several Public schools and barks commands. However, rep isn't paid for the extra work with me and he threw it to my face this PM.

He was pissed because I refused to vacate apartment and move to the Campus room.

 

I am not involved in Chinese teachers obligations and payments for their work and 'free apartment is part of my salary'. 

I didn't have time to ask him, if I can complete only 5 classes next week (instead 25 per Contract) and get full pay ....

 

Dentistry treatment is what 'washes the dirt of this School' here!

It obviously depends on the precise wording of the contract.... if it says "hot water" and personal private washing machine, you're in with a chance.

 

If not, your SOL.

 

But, yeah, I'd be doing the hotel option.... make sure you don't get stung with the hotel bill!

'40m2 furnished apartment with wooden entrance door & lock ....., kitchen with sink and two faucets .... ' There isn't such wording on any Contract I came across!

 

I usually ask about sit-down toilet ... First time I was without electricity in Fuk, because School didn't pay the bill on time, I told them I don't go to the class if I can't take shower and shave before the class. On Fuk's 'no electricity week', I started with classes on Thu. afternoon ... 

 

Another matter I had to 'spit it' out here was: 

1. as I completed ME last year, I called rep about tomorrow's time-table and he gave me day off/rest. Owner later deducted some 600 Rmb out of my next pay, because 'she had to get replacement teachers for my classes on that day'. As I asked for that money, they behaved like they are retarded (what I told rep). They simply kept 600 Rmb.

2. as I moved into the apartment in May last year, rep said: 'We will install air-condition .... soon!', which had never materialized. 

I wasn't here much in the summer, but in winter I needed a heat. I was sitting behind the computer dressed same as when I was walking outside minus hand gloves. I took winter parka off some 20-days ago.

3. I got a new sponsor in winter who wanted to see Release letter and I asked rep about it. Rep: 'I am busy today, but I'll write you RL tomorrow!' what I told to the potential employer in Shenzhen.

'Tomorrow', brick rings and rep: 'You will get RL after you'll vacate an apartment!' what seems normal, but he gave me promise a day earlier, what I transferred to the new employer .... of course, I didn't get a job.

4. I was on Medical leave 9 days in total in 13 months of working here ... I am permitted by Contract to stay off work because of illness for 10 days and receive full pay.

My medical leave history overall: 'I missed classes for less than 10 days in 7 years of working in China.'

I clicked the same ill term in 13 months here as I did since I am China (2009), or in other words 'I just called in' and stayed in bed. I wasn't required to bring MD cert.

 

Now, I obliged with rep's request to move to Campus room, .... and I called him 2 hours later with 'That is Contract breach ....' and 'I won't do it!'. 

I agreed to complete 27 classes a week in this Semester for regular pay and after the 2nd week, I called rep. and told him 'overtime must be paid 150% by Chinese law!'. I explained to him, School has 2 choices: either 'pay overtime by Chinese law' or 'rearrange the schedule back to 25 classes'. I didn't get his reply in a day and I sent another email: 'If you won't comply, I will skip last two classes on Saturday!'

He sent me a new schedule with 25 classes soon after.

 

"I stick him&owner into my toaster with top heat on" just to show them how do I feel when they jerking and bossing me around.

We'll meet next week in his office. I'll bring thermometer with me

It tends to be the minor details like this that piss a lot of us off... if pay isn't given as required, we get up and leave. But for hot showers, it might be something you tolerate... and thus, build up resentment for.

I was on Campus room just because owner couldn't get an apartment at my arrival in April 2016 and there's no hot water in Campus rooms.

I negotiated 1st Contract with 'housing on the Campus' with Q to the owner: 'How will you know, if student was/is in my room on Campus overnight?' 

She replied after 2 days: 'You are right! I must get you an apartment off the Campus!' 

I can negotiate the 'negotiators' i.e. 'penny pinchers'!

It's my mom's fault  anyway!

Several Chinese teachers (single men and one divorced-I guess!- with his son's visiting and living short time in Campus room) live there. I am not sure, how do they shower, but one day I was supposed to go in nearby Kindie and have few classes with babies, but I refused. 

I was nice with owner: 'Look, as soon as I come to the Kindy, kids are all over me. I can't go there if I didn't shower earlier!'

Soon after, I moved to the apartment off the Campus.

My city here isn't poor whatsoever. You can see many imported cars, even Jap's cars. Owner, she is driving 2nd-hand Porsche 4-6 seater... Wally has 'free climbing wall' by the huge kids playground indoors and similar. It isn't much different here than in Dalian or any other T-1 city in China.

Another horror story. I have heard 1 horror story for every 2 good stories. I don't know your personal situation. I remember working for some schools where the employer conveniently forgot I was married and gave me a dormitory for living. My wife rented an apartment for me. This happened twice during my 6 years teaching. I can only tell you what I would do. As I read your contract is another 6 weeks. Maybe your contract isn't as legal as you think it is. could be the reason your employer is brave enough to arbitrarily end parts of the contract. No idea what you should do. I would just keep working until the contract expires, and live on campus. In my view it is only 6 weeks. I hope you get the release letter.

The contract is legal, 'cause I spoke to SAFEA some 7 months ago and Gov. knows about troubles here. I also have all stamps&signs on the Contract and owner showed me 'laowai hire authorization' before I inked the Contract. Last 1-year RP extension is theirs.

The problem at that time was: owner thought she can cancel scheduled classes 15' before the start of 1st class and not paying for it, similar as she does to Chinese teachers.

Main reason why I signed Contract with 25 classes/week was that I won't need to look for part-time job, but I'll have everything under same Contract. 

If I wouldn't stand-up at that time, my Contract would easily turn into 18 or even less classes per week.

She is looking only through her valet (typical Chinese, she apparently studied in Canada...) and she disregards that FT came to China from abroad and instead of working in the classroom, FT would nap in her/his apartment. I told them we would never do that to Chinese teacher working at our School in West!

Newbie FT in this place would get eaten alive, so I will write a new post with the warning about this place.

As I understood, I am the School's first FT, but students were asking me in the beginning, 'will you stay here longer time or you will leave soon?'. There must be FTs before me here ... 

Scumbags asked me to go to the photo shop some 40-days ago and get the pic taken for new School's bulletin. 

I thought, School will most likely offer Contract extension (I hate packing&moving!), but rep replied a month ago: 'No, School won't extend the Contract!'.

You see, it's all planned: 'They're fishing for new students in September with bulletin and FT's pic in it, but I will be gone in a month!'

No other word but 'dirtbags'!

They are dirtbags toward foreigner-s and they are dirtbags toward their own people. However, I am sure they consider themselves as 'smart'!

I learnt something new lately. "Ironman" already put it in his words and it is practical.

 

Since people are unjust, in this situation you need to avoid adding  gas to the fire.  Unjust, people must already know what they do and have a plan to make it happen. Sure you can fight them, but that won't solve the problem unless the way you fight them preserves and ensures your priorities. You need to move on without looking back. Get out of there without damages at all, if that's possible.

 

Safe guard a place to stay, that is, rent  a flat for the time being and for the one needed until you have a clear path to the next school. Having an apartment rented until then, will help you to secure your way out of the one it seems it's already claimed. 

In the meantime, safeguard the paper work and the time needed for it. 

 

That's a way to play it wise and peacefully. If fighting them upfront will help you with anything you need,  you may do it but it will mean emotional exhaustion. What if you can fight them without getting emotionally involved? Certainly there will be some loss on the way out of there. Probably energy, money, frustration, either of them or all. 

If I am not wrong you already contemplate a change of the school. Focus on that plan and make it happen. You will leave the school anyway. It really doesn't matter that you will stay a few days more at another place. I would consider renting an apartment anyway. 

I told you about the injustice of people, that is not worthy to fight them, if possible not at all. Because they are unrighteous, they know  to be righteous too. Tricking someone with a contract signed and agreed upon by you and school, it requires mean and shrewd  spirit. It is not about changing them or showing them that they are wrong. It is about how that may affect your plans to move on, jeopardize your way out and make you live the "horror" worst than it is. 

 

When you deal with shrewd people, unless you have time and have measured the collateral damages, you better let them be. As I see, you don't have time to show them they are wrong. Besides, where you go you will find other mean and shrewd people ready to squeeze you with the contract in hands and they may be worst than those you have posted about on this thread. 

 

Leave peacefully as possible.

I agree with 'not adding fire to the flame', but I couldn't resist and showed them the same treatment from my side ...as they are giving it to me.  Rep. quit his 'FT's adviser job ...' and I have new Chinese English teacher who helps me around. 

Most of the troubles I have are School's responsibility anyway as 'yesterday's Internet connection foul out'.

Other thing when I need Chinese speaker is 'order 2 bottles of drinking water' every 10-days or so.

I will get help for shipping of my items from Dentistry manager, who is completely opposite. He and all MDs and nurses at the Dental clinic are the 'light' I have here ...

Other thing which get into me is 'I have blast with students, either in the School or outside in the city'.

There are around 1700 of them and they stop me outside with 'Where are you going? Are you lost?' and similar. I was invited to student's 1k pigs farm on countryside, but School said I can't go, because I am not covered with insurance .... Oh, well!

I am required to tell School, when I am leaving the city ....LOL. I traveled out of China (India) in winter recess and I said to rep: 'I am going to HK for a month ....' LOL

I had new 'story'/happening this week .... when one student repeatedly (3 times) said: 'Fuck your mother!', while I was checking how are students making short written exercise around the classroom and passing by his table.

 

That was the same student, I took in the teacher's office a month ago for similar cursing in classroom and I told his Chinese head teacher about it. 

 

The same evening, rep sent me an email about 'how will student apologize and how he is sorry from the bottom of his heart ...

 

I demanded, the student should not be in the classroom during my English class because he is disturbing my work and if School insists, he should remain in the classroom, I will exit and wait in the office until the end of the class.

 

My reply last night to rep in entirety (my mom always say: 'He never listens .... ', i.e. to an advice of Iron &PulSatre) :

 

Students understanding of my spoken English isn't my problem, but most likely responsibility of English teachers who taught them before me.

 

Your help which I need and I asked you several times contains of:

 

1st. 

Return of 600 RMB deducted out of my first salary for the day off granted by you after I returned to Bijie from ME in Guiyang! 

That funds were deducted out of my pay unjustifiable because I didn't ask you for the day off. You told me I can rest next day!

I want that money back and I asked you about it several times, but still no reply from you!

2nd.

Pay slips for my salaries in 2nd Semester, i.e. March, April, May and tax receipts for the same three months.

This is School's obligation and it's never shown on the phone to the employee like you did. I want pay slips, where I can read amount of salary and deductions of it!

 

Once, we sort that out, we can have a talk about help with translation in the classes. 

I am well versed in teaching English and if students don't understand me, I also show them a meaning of a new word or even of the whole sentence. 

I will also ask them few questions after my detailed explanation, so I'll know if they understand me.

 

The problem is on your side, but you don't see it. 

It isn't that I need help with translation.

Once, I bring the student to the teacher's office with my complaint, it's School's Board responsibility to sort the matter out with the student. 

Why do you think, I escort a student to the office? To hear the same matter repeat again a few weeks later?

No, I bring him into the office, so matter won't ever repeat in my classroom!

 

Now, if you agree with that (I don't see how you could disagree!), the student doesn't belong to the class, because he or she is interrupting my work.

 

I just finished the class in no. 19. They don't care for English whatsoever. However, none of them curse (in English) during the class. I try my best to represent them a lesson, and they aren't interrupting me like the student in class no. 6.

 

That is entirely School's Board responsibility and none of the foreign teacher's responsibility.

I am a professional foreign teacher, i.e. I make my living by teaching English in China and not the student on vacation doing the same work. I know my responsibilities and I am not asking you about it!

 

I am telling you (to your School's Board), which was eager to issue unjustifiable Contract termination, but they are unable to stop students cursing in English during my lessons.

Strange teachers Board that is!

 

I am aware of with who I am dealing at Lanyuan School since your lying about my Recommendation letters, i.e. your 'you cannot handle big classes as a statement out of Kaifeng University'.

 

You must lie to get an upper hand over foreign English teacher working successfully in China since 2009. 

 

Some teachers you are, all of you!

Never threaten to not do your job. Then you're in the wrong (learned that the hard way). Give your 30 days notice  and walk , secretly video the kids behavior just to show the parent. 

You screwed up from the start. Whenever there's a serious classroom issue, document it (video preferably), communicate in writing; emails/ texts. 

Your situation, 1. go to school and demand meeting with student's parents. 2. demand a meeting his/ her classmates' parents, send a note home with students. They'll be pissed because it's disturbing their kids learning if they even care.

These days, mental disorders are on the rise in China (shitty parenting and toxins in the water and food)

I took him in teacher's office and told his head what happened. I told rep. about it too.

 

A month or so later, he goes again. 

 

I bother more Teacher's Board at the School then anything else.

They would send FT home after 3 m for some pretentious reasons and of course School demanded Native English teacher. And don't forget she or he came from USA or UK .....to teach English in China! How bad is that? 

I told them, 'not cursing in English during my classes' is my condition to teach English in China!

 

That cursing happened in last two months. I am finishing the Contract by the end of this month (last working day).

If Teacher's Board can't stop student's cursing (in English), they can have him in their office during my class! And if I hear cursing in any other class, I will exit the classroom and wait till the end of the class in my office!

'add-it': 'while I walked with student toward teacher's office, he said: 'I didn't say it to you!'.

Think about that! Little mastard was couched about what to say ....

Here's why I teach uni, told those 3 to transfer out or fail. At my age . I don't tolerate BS, if schools can't deal with it, 30 days I'm out.

I misunderstood ... because in Fuk's Primary I had few mentally impaired students at Grade 3. I tell you they were my fav. students. Their English was also better than other kids, because I pay more attention to them, especially at our lunch walk home. 

 

But again, it isn't my duty to deal with such students! That is a School Teacher's Board duty!

If they can issue Termination notice for pretentious reasons, they should be able to deal with troublesome students too, I'd say!

 

 

I had talk with rep today and he told me that at our School, there are no classes Headteachers, but every class carries pic of Chinese teacher by the entrance! He is also suddenly not my boss anymore, but just an English teacher! However, he determines my working schedule.

They all get demoted, 'cause Chinese lawyer is watching ...

Mentioned student won't be in my class next week as per my 'wish' ... LOL

Bastards they can turn around anything! It isn't student's or Teacher's Board fault, but 'my wish'! voilaaa
