Q: why the cancellation of your old alien employment permit important?

1a. why is it necessary to cancel your old alien employment permit or FEC?

1. Is it needed when applying new Z visa or when transferring job?

2. I currently have alien employment permit (from a company) which is not canceled yet and at the same time a school applied working permit from the SAFEA for me and have got it issued. Is it necessary to cancel the alien employment permit before heading home for the New Z visa or I can go and apply the New Z visa , then when I come I can be rest assured and go ahead to cancel the alien employment.

is the cancelation of alien permit checked in the Chinese embassy or will be checked when we are going to apply working permit after my return to china?

Yes, you are registered with FEC as 'foreign employee' in China.

1. You must return FEC to School for cancellation before you complete Contract/resign/leave.

2. School must submit FEC cancel certificate to you in 30-days after your last working day. ----> Chinese law!

You can extend your/present RP with another employer, i.e. 'not exiting China', but you need Release letter and FEC cancel cert.

You will need both documents also, before you'll get all docs. out of School necessary for new Z visa.

What I meant was , After I left my school in Hangzhou, The school canceled the FEC and gave me a copy to transfer my visa to new employer. Since my new employer isn't a school, they applied alien employment permit. So at the moment I have valid alien employment permit. But I want to stop working in the company and go back to teaching and luckily, the school has applied and got me the " work permit " to send it home for New Z visa. The alien employment permit and the FEC are different. so as I am going home to apply new Z visa to teach, is it necessary to cancel the alien employment permit before I leave or I can go for the Z visa then when I come then I tell the company to cancel it.

- after you'll complete Contract, your RP will expire too. Your present employer must take you to PSB (Exit-Entry cops) a week before RP expiration.

PSB will grant 30-days RP extension. (In some Provinces was 30-days L or S2, and in Fujian I got 30-days RP extension).

One can use 30-day RP extension grant either for 'traveling and exiting China' or 'changing of employer': 'travel to the new city of work, where employer will have sufficient time (30-25 days) to apply for new FEC, new Medical exam and finally PSB for the new Contract length RP extension.' No China exit is required! No new Z, either!

You could dial SAFEA and ask them about the proper procedure. Enter 'SAFEA' in search above for address and contact no. in your Province.

I tried to change my alien employment permit to FEC so that i can teach or get new RP without going home but I was told we can't transfer company working visa or alien employment permit to FEC . so they told us to start.

Request to exit China and apply for new Z is usual thing (at teaching, i.e. FEC), because employer can't get stamp on Invitation letter with Hong Kong Z pick-up out of SAFEA. SAFEA sometimes (especially in T-1 cities), requires Z can be applied only in FT's home country!

Yeah, my questions is, Is it necessary to cancel my current alien employment permit that the company gave me? cuz this alien employment permit will expire in November but my company has told me I can quit and go back to teaching. so do I need to cancel the alien employment permit before I go home or I can go home and get the New Z visa then later I can tell the old employer to cancel the alien permit.

Of course, it is necessary to cancel 'alien permit', if you want to change an employer. You can have only one 'alien permit', so it must be canceled, before you'll get new FEC.

Cancel 'alien permit', before you exit China and request 'alien cancellation cert' asap, which you must present to the new employer together with Release letter.

New Law on April 1st, will certainly make transfer process a bit different. This is the reason, I said dial SAFEA and ask 'how to ..'.

Thanks but I wanna let you know I'm not transferring my current visa. I have started New Visa application with my school But I still have valid alien employment permit and residence permit up to November . I will go home to apply new Z visa under the new visa policy to work in my school. I don't know what to do with the current alien employment permit have now. I just want to go home and apply the z visa to work in my school , then when I come back I can tell the company to cancel the alien permit cuz I won't come there to work again. I'm scared that if I cancel the alien employment permit and I didn't get the Z visa to work in the school, I will lose my job. I have job now but wanna go back to teaching

A:Can a new employer help you? Possibly but it's really hard to say for sure. I used to be involved in hiring new teachers and a couple of times we had people we wanted to hire who were having trouble with their old school - situations similar to yours. Our school was legally able to hire foreign teachers, did everything by the book and was well connected, usually schools that mess people around with visa stuff aren't operating legally so a call from our visa guy to theirs telling them they were breaking the law, we were in the middle of processing the visa stuff with the PSB and the next phone call they got regarding this teacher was likely to be from the PSB asking some hard questions was usually enough to get them to co-operate. No school doing illegal stuff wants the PSB getting too interested in what they're doing. There's a chance a new employer could figure something out if they really want to hire you but these are difficult times, their hands might be tied too. -- Stiggs
