Q: Why can't people on a spousal visa work legally in China?

What are they expected to do, stay at home at be a good housewife/husband and die of boredom? So what, they have to choose between being on a spousal visa and not working or doing it the hard way and coming here on tourist visa and then trying to get a job that gets you a work visa? Why is China so ridiculous sometimes!

Each country has different types ov visas, and each type has its own rules and regulations to observe.   In your case, the spousal visa is to allow the family of the working person to accompany him or her.  If the spousal holding visa can get a job offer, then have the prospective employer change your visa from spousal to working type.

Remember, if you are from USA. unless you have a Residence Visa and a SS number, you can not work legally there.

That's exactly what I do...staying at home and taking care of my child....

Theoritically, it's true that you can't work with your visa, but I am quite sure that the rule applies only if you work or provide services in China without being declared and you get paid in China. If you work here from home but you provide services for instance only to US, French or UK companies set up abroad, and that you get paid to a bank account abroad, I hardly think that you're in tort.

The only thing is that US or European companies often requires a VAT number to do business, which you can't get except in you're registered in one of this country.

It is BS, my Chinese wife is eligible for a Green Card in the US, yet I can only have the equivalent of a long term tourist visa here.

Because money is power!

Your other half is clearly a success and possibly even a figure demonstrating near-supernatural heroism, while you are clearly capable of providing nothing for the greater good.  Such failures should be kept obedient and docile (preferably using chains and medication).  Obedience is best ensured by fully stripping you of the few remaining powers that you might otherwise hope to cling to in order to feel a shred of self-respect, namely financial independence and legal security (i.e. dependence on the visa system).  If they could think of a way to incorporate into said visa system a way of controlling what you wear IT WOULD HAPPEN. angel

Because the CCP is derp. My wife was able to find a job upon arrival in America. Even the Japanese got this right. You can work in Japan in pretty much any field you're qualified for -- and then some -- if you married a Japanese person.

From my perspective it is because it drives me to despair.

I am self employed. I have set up a business, invested substantial amounts of capital, I am forced to employ Chinese labour, I am forced to operate from an office that is different from a residential address, I am forced into paying other corporation and personal taxes and I am loaded with additional overheads. That is the cost of operating legally in China. Those additional overheads have to be factored into quotations I give to potential clients.

Do you think it is fair that someone can work from home on a spousal visa with no such overheads and thus be able to undercut everything that legally self employed people can offer?

They didnt ask to work ilegally they asked why werent spouses married to Chinese given an automatic right to work.   LIfe  is not fair, China is not fair, the US is not fair.  If a person doesnt like paying all the extra expenses, and being forced to comply with a bunch of rules and regualtions, which by the way I agree with you.    I think they should consider other options outside of China for doing business.

A: "... through ..."?  Only "through" comes to mind is "Shenzhen agent can connect you with an employer, who's authorized to hire waigouren ... and can sponsor Z visa." It's not like every 10th person you meet in Shenzhen's hood can sponsor work visa ...  The only way to change from student to labourer visa is just a regular way by: 1. Finding an employer, who'll apply for an Invitation letter; 2. Exit China and apply for Z visa in your home country's Chinese embassy; 3. Enter China in 30-days after Z visa was stamped into your travelling instrument ...As I am aware, you won't be able to switch to Working permit by remaining in China....,so make ready for a return to your home .... -- icnif77
