Q: Why is my Z visa not cancelled?

I left China around 8 months ago, abruptly for sound reasoning. Gave the school a few days notice, and left. They were not happy as I was only 2 months into the Z visa. I understand their frustration.

While back in my home country I obtained a 2 month tourist visa, assuming my Z visa would be void. Then when I re-entered China, the officials said I can use either visa, it is my choice, because the Z visa still has a few months left on it.

So I chose the Z visa. Why is this visa still valid, and is it good for the rest of its duration, or would I need a new work permit to keep it valid?

Ok, I just looked in my passport, my Z visa expired 8 months ago(was only good for 3 months). I geuss I entered on the resident permit. All 3 officials looked at the resident permit and my tourist visa, and said it is my choice, they said write down that number, pointing to the resident permit page. So what the heck, will they process my tourist visa when they realize the mix-up, or do I have to go somewhere to have them do it.

Also, if I get a new job I guess I won't need the release letter from the former employer, we will just start new.

By Law of China, you can not have two valid visas in your passport at the same time.  When you got the 2 months tourist visa, the work visa was canceled, even if still looks OK in your passport.

Evidently, the Officer at the Immigration station at the border when you entered China did make a mistake, but he should have known that only the latest one issued was valid.

your work and residence permits are not valid because you no longer work for your former employer, and they are tied to him.

You may, or may not, have a legal problem in your hands.  I am not saying you have broken any laws, because you did get a tourist visa before coming, but it seems a canceled visa was used to gain entrance (the officer's mistake, not yours).

That is an exremely strange occurrence on more than one issue.

 

Firstly, I assume you mean that your RP from the previous employer still had time left on it. The embassy or consulate where you obtained the tourist visa must have canceled the RP before issuing the new visa. Technically, because the RP hadn't expired, they should have checked the release letter from your previous employer before proceeding. 

 

However, on re-entering China, a border guard should have at least the basic knowledge that only one visa or RP can be active at the same time. By scanning the RP, it should have been possible to ascertain the precise date of cancelation and by whom. But the only valid visa would be the most recent one (the tourist visa).

I think you need a release letter for another work permit/ Z-Visa, but not for any other type of non-employment visa.

I believe that the consulate or embassy have the right to ask for evidence that the contract of previous employment has not been breached where an active RP still exists. The reason being to prevent persons from "doing a runner" from a job, exiting the country, applying for a tourist visa then returning to seek new employment.

This is really strange, because they have some kind of database where they record and check the visa information. Or that is what I always thought from watching PSB officials and border guards over the years.

You might be onto someting. Keep us posted. Wink

this is peculiar but having a national database, not likely, while i was on an interview for a big university , the psp called the  guy im talking with and asked him if had any filipino teachers working at the school on a work visa and their names, he indicated that if political tensions rise over some islands , they may be sent home. so i ask the guy im interviewing with , does this mean the psp who issues the work visas is to lazy to check their records of z

visas issued to find them or they dont have good records, of course he did not answer my question

makes me wonder now

your company did not cancel it. and if they cancel it they have to give a notice.

that is depend on the company. I'm a manager in a school and it's less work to not cancel it. so that is why we also do not cancel it. as long the worker leaves the company nicely and not in 2 months hahaha. i think your old boss is nice to you.

I got a school that can do my visa and on April this year on the 15th the Z visa was out.

For the Summer holiday I went home and overstayed for 9 days but which I had already contacted the teacher in charge and written her emails. When I came back they told me they want to cancel my visa coz I was late and id ont want to look at the evidence of the emails and texts between me and the teacher in charge. So later they asked me to sign a letter of termination of contract which I refused. After a week the teacher in charge of the issue sent me a text that they will cancel my foreign expert and I can look for another job because the school that had helped them do the Z visa has issues and the are very sorry...until know I dont know what to do...do I go to the immigration  in my city where I got the visa and ask about it or do I stay continue looking for a job or should I go home or HongKong to change my visa?

I'd suggest you start a new question yourself to avoid confusing issues. 

 

Also so explain the situation a bit better. It sounds like your FEC & residents permit were got in the name of another school, not the one where you are actually working. 

 

Start a ne question, give a bit more information & I'm sure you'll get good advice.

they did not cancel your Z visa, they cancelled yer residence permit. Z visa only lasts 30 days. wait actually they cannot cancel yer residence permit unless they have it. hell maybe you just overstayed. go home or hongkong
