Q: Will I be affected by the one child policy if I decide to have kids in china?

Im considering to begin a family, no wasting time any more

You have posted a very interesting question, and with a very complicated answer.  Let me explain as short and as clear as possible.

You, as a foreigner, are exempt from the Law. But if you marry a Chinese national, he/she will be under, so the Chinese National will get penalized.

And to further cloud the issue or answer you requested, we also must consider the baby. China considers any baby born in China a Chinese national, and will treat all as such. So, if you have more than one baby, the baby will suffer whatever consequences are indicated under the Law. BUT, if you register your baby's birth with your Embassy, he becomes a "foreigner" since China does not allow dual nationalities like many other countries. So, if you have 4 kids, all registered with your Embassy, they will no longer be consider Chinese babies, but foreign babies, and no penalties will apply.

And a warning, here you never know how an official will react. While something is OK in one place, in others is severely punished. But many couples in China have more than one baby, and lately hardly anyone gets caught. But maybe they have the right guangxi.

this is a very interesting topic ,,,,,, I have no desire to have more kids..... but if I did, I would...  government or no government ,,,,,,  wife and I  are comfortable with our family as is...  she has a daughter and I have a son and together we have this complete family.

I do believe that "the one child policy" has worked and maybe even most adhere to it ....but I don't think they care here .....  same attitude I got..... if I want another kid,,,I will have another kid...............  some folks here adhere ,,, many don't

As long as you do not get them the Permanent Household Registration and only a Temporary Household Registration and a Foreign Passport, there are no penalties, with the Temporary Household Registration you can apply for the childs Exit Card so they may leave at the proper time to apply for the Chinese Visa, mine rides on my Resident visa and he only had to exit one time, second baby is on the way.

If you are chinese but marrying foreigner partner, then it is not problem for number of children.

 

If you are chinese and ur partner too, go to HK to register  and give birth so also no problem. as I guess
