Q: Work Permit/Residence Permit?

I asked a question yesterday but i've just found out that the information in it was wrong. 

 

I am changing jobs in Shanghai and wanted to know which documents I would need, turns out that as I haven't applied for my residence permit yet as I only went to Hong Kong for the Z visa (despite starting work almost 4 months ago now) a week ago, my school still haven't applied for the Foreign Expert Certificate.  Does this mean, as the new school thinks, that I will just have to re-apply for the Z visa in Hong Kong and let them apply for the FEC?

If you didn't get your RP yet there is no way to transfer it to a new employer, also if you are terminating your contract earlier your employer can (if they like you or whatever) but is not legally required to give you the letter of release (they are if you completed your contract and didn't break any term), means that without this letter you will have to start the entire process again (go to HK or back home, ...). And you are legally required to keep the FEC, not your employer, usually they want to keep so that they can cancel your visa in just a matter of seconds by going at the PSB, I tell my new employers everytime to add on the contract something like "Party A (me) will have the right to immediately terminate the contract without penalty If Party B (employer) refuses to provide Party A with the original Foreign Expert Certificate"" before signing anything, most employer will refuse for the aforementioned reasons, doesn't matter, they are crap if they don't play fair and I wouldn't want to work with such people anyway.

yes, you have apply for the whole z visa, FEC and resident permit again . Z visa is only one-month valid for you to stay in China to apply for the resident permit. 

 

 

Hopefully your new school can assist you to apply for it. I just wonder, When your z visa was expired, what kind of visa you are holding? if you don't have visa, it means you overstay in China for almost 4 months. well , the fine will be huge I guess.
