Q: Work visa cancelled by PSB and given Stay visa

Hi there, I hope I can get a helpful answer from somebody here.  

If anyone plans to just flame and attack me please just do not make an answer here thank you!

 

I worked for a kindergarten, introduced to me via an agency. Agency helped process the Z visa for me. (At that time you could change from L to Z in country) - did the health check, gave the required documents. Did the PSB visit and all, few weeks later had passport with RP in it.

 

5 months into my job, the PSB comes to the place where I worked and saw me, asked all the teachers to show their passport. I had a Z visa, others had L's. The police told me that the Z visa I had was not for that kindergarten, and the agency that "introduced" me to that kindergarten was not licensed to have foreigners. They gave my company my 5000RMB fine to pay, and 5 days in detention.

 

The guy told me I won't be deported, and the PSB issued me with a "Stay visa" which is just one way only.  They never said how long until I could return. A few have hinted at 2 years. Especially because I left with "a visa", not carted off by Immigration.

Anyone familiar with this scenario or could find out for me? I asked my embassy after not getting a L visa this month. 2 years arent up yet.

 

I welcome any advice, i don't welcome any critics, just another foreigner who got fooled by an agency.

Also i want to add that although you don't get clear answers; here are some that i've been given

 

I called the PSB from my home country (Australia), told them all the above, he said "the stay visa is a kind of 'Punishment visa"" (funny way to say it), he said "according to regulation, for 2 years no work visa".

 

The embassy said that they don't see any longer than 2 years, as i wasn't deported.

When did all this happen? I'm asking because you said "at that time you could change from L visa to Z visa in country"

 

your rather confusing post suggests that you've just been rejected for an L visa as "your 2 years isn't up". That suggests this happened in under the last 2 years. It has not been possible for more than 2 years to concert an L visa into a Z visa "in country" so your question sounds rather dubious!

 

if what you write is true then you are barred for two years.

BTW I understand that people think it is impossible to change your visa within china and maybe in most cases it is. But i swear on my life the boss at the previous school I was at managed to change my l visa to a z visa in shanghai. i went to some visa agency then a while later i went to immigration place with visa agent got my passport back a few weeks later, all without leaving country

@dokken: you might not have left the country but i would wager your passport most likely did. Where on your z visa does it say it was issued?

ah actually just checked my passport. it had a yearlong RP and a cancelled L visa. Icame on an Lvisa and never left China. Im back in the U.K till august

TBH dokken, I done the Z visa stuff the classic way 3 years ago, and got a 3 year RP from it. The company just renewed my WP and RP. I did not have to do anything. But, my contract expires next month, so I asked the girl how she got me a WP without me having signed a new contract. No need, she said. Erm... I agree with you dokken, anything is possible here. And a strange thing, the wording on my RP changed. under "reason", my old RP said "seek work". My new RP says "work". My work permit says "big manager". But I aint a manager. My wife says "seek work" and "work" are the same in Chinese.

Sorry i forgot to make that clear;

in 2012 December i came to China on L visa
a few months in found a job; the agency helped apply for the RP around Feb .

I left China for 2 months to visit another country (using the RP as a means to leave)

Came back to start my job in June; then the psb came and all that happened in November 2013. Then i had to wait for the investigation. Finally I'm told 5 days 5000RMB

RP canceled and given stay visa. Then left China A week later.

Denied a visa last month

I just like to hear other peoples experiences if similar to mine.. Am i being punished less as i did have a work type RP.. Instead of getting the full deportation treatment ?

If anyone's going to the psb could ask or anything.

Why havnt you changed your passport? If your country is one which gives new numbers everytime a passport is issued then you will be safe to get another visa.

Because its not the passport number They record.
It's your name and birthday and birthplace

I don't think it is. I think they record only your passport number. i could be wrong. I remember somebody telling me about it

Many and tons of naughty teaching guys I know today and knew back in the old days did the whole " get a new passport number". It is the passport number#, so many if not millions of us have the same name and a small chance the same birthday. It's the passport number that needs to be changed than you'll be fine. BUT not all countries change their passport numbers during the renewal.

BYW please capitalized your "i"'s before coming back to China. Best wishes or condolences, which ever comes first man. You dug your own grave in China. This should be a wake up call NOT to use agents!!
