Q: Working permit that has been cancelled for 3 months

My working permit has been cancelled by my previous employer for 3 months already since I started my new job here. But the problem is until now, I do not have a new one. My current employer keeps on promising that they are still processing it. My problem right now, I wanted to leave. This is my first time that I wanted to leave a job very early. I just can't see myself staying here any longer. It is so hard to explain but I just feel so pressured here and the people around me are making me feel they do not need me or they do not want to help me with the things that I need to know since I am a newbie here. I just wanted to leave and look for a new job that I would somehow feel happy. This place for me is a place I never expected. But the problem is, my working permit. It has been cancelled for 3 months already. They are not doing their job here I think. Would it cause me a problem looking for a new job? My residence visa will expire on July 2021. I still have time with my reaidence visa but my problem is my working permit. Please help me. Thank you.

Working without a work permit is illegal, and many local governments have been on a push to catch and fine/deport illegal workers, so...

Be careful. The days of greasing palms with a nice Hongbao seem to be over. 

Who is your current employer? What city? Name and shame them everywhere. The work permit process only takes a few weeks, so if it's been three months that means that they're never planning on giving you one.

I don't know what to suggest other than to start really pressuring them to get you your WP, it shouldn't take three months to get, I suspect they're not being honest with you.

 

In the meantime, unless you find a new employer who can sort out your visa situation without you having to leave the country and you trust them 100 percent, don't leave,you'll most likely only make your visa situation even more difficult.

thank you so much for your suggestion. But do you think there would be a new employer that can help me with my problem? I mean do you think I can still look for a new job given the fact that my working permit has been cancelled for three months? Because I really think my current employer is not working with it. Yes, you are right. I think they are not being honest with me. Because if there is a chance that a new employer can work with it, then I will have to search for a new employer while I still have time. I have a relese letter from my previous school.

Can a new employer help you? Possibly but it's really hard to say for sure.

 

I used to be involved in hiring new teachers and a couple of times we had people we wanted to hire who were having trouble with their old school - situations similar to yours.

 

Our school was legally able to hire foreign teachers, did everything by the book and was well connected, usually schools that mess people around with visa stuff aren't operating legally so a call from our visa guy to theirs telling them they were breaking the law, we were in the middle of processing the visa stuff with the PSB and the next phone call they got regarding this teacher was likely to be from the PSB asking some hard questions was usually enough to get them to co-operate. No school doing illegal stuff wants the PSB getting too interested in what they're doing.

 

There's a chance a new employer could figure something out if they really want to hire you but these are difficult times, their hands might be tied too.

There's no reason you couldn't start looking for another job (quietly, so your current employer doesn't know), let them know your situation... who knows, you might find someone who can help.

I suggest that you go to the work permit office and find an person of authority to ask these questions. You might want to take a few hundred rmb to grease the palm a bit to "keep it confidential". They can tell you what your options are. 

 

I can understand your frustrations about the paperwork authorizations, but I am concerned about your inability to work where you are currently. You complain that they are not taking you by your hand and explaining things to you. Welcome to China. If they have given you your schedule, then go do the work. Since you gave no real details of the work place environment, or the job you are doing, it is difficult to assess your circumstances. Perhaps you need to ask some personal questions about yourself. Are you right for the kind of work you are doing? Are you part of the problem? Are you setting higher expectations than the company does? I understand that there are some really crappy employment situations, not only here in China, but all over the world. Your complaints may be 100% valid. You need to not only evaluate the company, but also yourself.

There is a real shortage of foreign teachers at the moment and schools are willing to go the extra mile to secure one. This could be to your advantage.

As Nash suggests above, it's a good idea to go to the place that issues visas and talk to them. Even if they can't solve your issue there will be records that you are trying to sort it out if it l goes sideways.

Remember the officers would rather you suggest an easy fix than for them to do anything. It's how the roll.

I am waiting, somebody will name that office which issues WP. I cannot find anything over the web.

Before 2017 changes, that office was called SAFEA. I bothered them at almost every contract in 8-years in China. They always helped me, too.
