Q: Would not wearing a seatbelt have a big impact in Chinese court?
Was the front passenger in a taxi car crash and I'm trying to sue the company for damages. Problem is as most taxis don't have seatbelts I didn't even think to check if there was one, and therefore wasn't wearing one during the crash. Anyone know if this would dramatically affect court findings as in Europe its purely the driver's responsibility.

Wearing a seatbelt is required by law now which can result in 2 points off your license if caught. I'm not sure about the driver's responsibility for passengers, but I've had taxi drivers require me to buckle my seatbelt before. If your taxi didn't have a functioning seatbelt, then that would probably be material to a suit. However if the taxi did have a functioning seatbelt then I'm not sure if it's your fault or not.
