Q: Second child policy - how does it work for mixed couples?

I have had lots of trouble,saying a second child is illegal so if you ever need any help feel free to contact us,as i wish i could have found some help i mean mixed couples,with first child being born in Europe ETC

I am having a bit of a problem understanding your question, because it sounds to me more like a statement than a question.  Am I correct ?

A second child (in China) is not really illigal in my opinion.  And depending where do you live within China, number of years between first born and second born, if both have the same parents, the "guangxi of the parents, etc.

In general, the one child policy is kept in a tighter mode for those who live in cities, and in a way, in a lesser or looser way for those living in the countryside.  Also, for example, if a couple gets married and have a girl, and later divorce, either one who remarries can have a shot at having a boy, and the one child policy still applies because it has been interpreted as one child per marriage.

For those living in cities also, a second child born 5 years after the birth of the first one is also allowed at present times.

Believe me, it is not as easy as one child allowed and that's it, more than one is illigal.  Even how the policy is interpreted and applied by different officials at different locations enters the equation to further mud the waters.

Really it's the otherway around, the one child policy is for the country side people and to keep the population in these certain areas and poverty levels down. The city people are being allowed more than one child, especially if the living conditions are favorable.

As a foreigner and married to a Chinese citizen, you are allowed more than one child, depending on what province and the spouses hometown. Usually the capital of the spouses province controls authority but I have run into situations to where the local hometown government could over power the larger authority in certain areas.

For example: He Bei Province, if a first child is wanted, you must first have permission of birth from the local authority, proof that you have no other children or there could be a 3,000rmb fine. If you are with child and ask for the permission of birth it's a 1,000rmb fine for every month you didn't have premission, and all second children are denied unless one child has a different nationality.

Crazy laws, by the way, this law still stands and was created in 1968

I am under the impression that if one of theparents is foreign AND the children are registered as foreigners, you can have as many as you want.

If one parent is Chinese and the baby is born in China,then the baby has to be Chinese,you can renounce citizenship i.e Chinese but not if your living in China you have to leave the country

Paul, depending on the fathers nationality, that is false. An American father can give American citizenship on a child's birth certificate even if the child is born and lives in China.

Wow, a little off there. The child born in China cannot renounce citienship until he is 18 years old. The child can have a different passport as my son does and he exits to America when ever I go for a visit. The law states that a child born in China is Chinese but the parents cannot renounce citizenship in liu of the child. However, they can hold a different nationality
