Q: What are the chances of my residence permit transfer getting rejected?

<p>I am transferring my work permit to a new job in the same city. I was able to obtain a release letter from my previous employer without too much trouble. However, the release letter states that I was late to class and may also state that I was fired. In other words, the release letter is a negative review. I won’t get into how this is a different release letter than the one &nbsp;I signed. Suffice to say, do I still have a good chance of my work permit transfer getting approved? I have read on this forum before that the recommendation part doesn’t matter so long as the other legal requirements are met. I love my new employer and I really want to work with them!</p>

Your new employer should be working on the residence permit for you. That is usually taken care of by them. As long as the new employer wants you, there should not be any issues.

@Stiggs that’s good to know. I haven’t had any legal trouble in China so I hope it will be ok. This is an unfortunate situation where the school presented me with one letter (a clean one) and then sent me this crap instead. The letter even mentions that I was uncooperative during the epidemic procedures. Really shady stuff. I have a clean health record and of course I have followed all directions for testing.

 

The last part in particular is bad because, as you mentioned, the gov would only want to get involved if there would be a threat to China as a whole. While the school’s claims are fraudulent, my issue is that the gov will simply deny the application out of precaution.

 

@icnif77 its a fair question. The reason why I’m asking is that if the risk of this not working is high, I’ll try and offer money to the previous school to get them to sign their original RL. You’re obviously right that nothing is 100% but I did pose this question in the hopes that someone with background knowledge could help.

 

Are you learning English yourself right now? I’m a math teacher but I’m sure I could find time to help you.

Release letter contains info mostly about you completed the contract and you are free of any commitments to your last RP sponsor, i.e. you are free to go/transfer WP/RP ... 

 

I've never read any 'cause they are all written in Chinese. All of my RLs were very short, 2-3 lines the most.

I would say, Recommendation letter on other hand, describes what kind of teacher/worker you are.

 

'Getting fired ...' would state that you didn't complete the contract, but I assume, if that would be the case, you wouldn't get Release letter.

 

I would say, there is nothing to worry about. Release letter must be presented to the gov. org., which will complete RP/WP transfer, i.e. paper work.

Yes icnif77 that’s what I believed, and I have read and asked many sources now, all of which are agreeing with you. Even the HR found their release letter strange as it was essentially a negative review included. But as everyone has told me, it doesn’t appear to matter so long as my new employer wants to hire me (they do).

It's better to wait for an end of transfer since rules have changed in 2017. I am talking about matters before the Labour law changes.

For transfer of RP/WP before 2017, one needed RL and FEC (Foreign Expert Certificate) Cancellation cert.

I would guess, your new sponsor/school could find out about it once you present them with all required docs. for transfer.

As a warning, I would say, don't believe to your new sponsor too much. They pretend whatever they say and they will turn around swiftly at first show of problems. Bottom line is ''you are a money-maker for them ...". Don't think there is any 'love' included ...

"So, try and sit on several chairs at the same time ...", wise man would say, i.e. apply for job at several schools in the same time and then choose the best offer and finally sign new contract.

I've always done it that way and when I didn't do it, I usually had to exit to HK or return home and reapply for new Z.

With the new system, if you leave under bad terms, it can, theoretically, impact your ability to get RPs in the future.

icnif77 the real issue isn’t if the job will hire me or not; the issue is whether the government will approve the transfer of the WP/RP. From what I understand, it won’t be a problem, but honestly your last comment confused me. I don’t think the government will care, but then again, the release letter is a bad review and it seems there’s a risk the government will not approve that.

 

Can you provide any insight on that specific question, and not on whether other schools will hire me?

I used to be involved in hiring teachers and your situation is pretty common. How it has been explained to me in the past is...

 

When the school has a good relationship with the VISA people at the PSB - and they no doubt will if they're licensed to hire foreigners - as long as you meet the basic legal requirements (and even if you don't sometimes) the PSB are happy enough to let the school hire whoever they want. If you turn out to be unreliable or whatever that's the school's problem, not theirs.

 

Obviously if there was a big red flag against your name - you had a history of getting into bar fights or recruiting members for your church back home or something for example the PSB might deny you because you'd be a risk for them but generally they're easy going about it.

 

I realise this isn't any kind of defiinite answer and things do change but if your school is generally trustworthy and confident they can get you transferred ok then there's a good chance they can. They're the ones dealing with their mates at the PSB afterall.

As I told you earlier, Release letter doesn't/didn't describe one's working ability and habits, but 1. party B (teacher) has completed the contract; and 2. party B is free to undertake job at another employer.

Your new lovely employer will abandon you at the first sight of the troubles at your hiring.

As Spider is telling you, maters in China might changed after new law in 2017.

 

Be ready to return home and re-apply for new Z ...
