Q: What happens if the recruiter cancels my visa?

Hello everyone! So here's my situation. I got a job offer in Yangjiang, Guangdong. I moved here but they didn't respect the rules and the lines of our contract. I'm on a Z visa but I haven't applied for work permit residence yet. Under my visa section on my passport said I have 30 days to apply for work permit residence after my arrival. Since they didn't respect the lines in the contract, I decided to quit and go to my home-country. The agent said she would cancel my visa. So what does that mean? Can I go back to my country safely? I already booked my ticket. But I'm so worried about my situation at the momentz

You can exit China under Z visa anytime you please. However, most recipients of Z visa apply with employer's help for Residence permit after the entry to China.

 

Z visa is valid 30-days and you can do whatever you want, apply for RP or exit China and return home.

Z visa cancellation is impossible, I'd say, unless you committed a crime and even then cops would just wait for the expiration date..

 

That what recruiter said is bluffing, threatening, so you would change your mind and eventually start to work at the school. Recruiters get paid for your placement only after you start to work, ... I think!

 

 

'add-it': 'Prepare an excuse for the Exit cops as sudden sickens in the family or similar, but I don't think cops will even bother you at the exit at all.

I've just never heard for such an example, so have some excuse ready.

In my time in China (pre-2017), I'd apply for RP, get new employer and then quit because of employer's disrespect of the contract. Moved to the new employer's city shortly afterwards and kept RP intact.

Matter a fact, I did that once in 2013 or 14. I got tired of HK's congestion and signed new contract with a shady employer (Hangzhou Helen Group) I knew from earlier. I quit the contract in less than a month time and moved from Lin'an to Fuzhou. New employer just changed city of my RP and I stayed in China like nothing had happened.

You ought to be crafty in China ...

if you have already booked your ticket, just leave.
Chinese employers will look for ways to exploit you and ignore any written agreement - take this as a given.
at this point make sure you have your passport and not the agent, otherwise you are ****ed.

gather evidence of breach of contract by your employer in writing - this could mean you emailing the breaches in contract that you have experienced point by point.
document and record EVERY step.

do not accept what you hear in meetings or by phone without written back-up.

chalk this up to experience and move on - preferably in another country.

I have my passport and my tickets are ready. I'm flying back home on Friday. She said, " if you wanna quit, we will cancel your visa and you can go back to your country." I just wanna make sure I can exit China without any problems. Since I'm on a Z visa and I have 30 days , I guess that would not make any problems.

If you are leaving on Friday, don't give your employer these details, as they may try and obstruct your departure.
Make sure you have outlined to them, clearly (in simple English so as to avoid any 'misunderstanding') in an email, all the breaches in contract that have occured point by point.
Evidence is crucial, as is demonstrating that you having at least offered your employer an opportunity to rectify things.

"Hurt feelings" are not enough to break a contract.
I will repeat, you need to present (in writing) evidence of contract breach and maybe evidence of attempts to resolve this - for your own protection should you want to work in China again. Failure to do so would not reflect well on you as a diligent employee.

This is basic stuff.

Also make sure that all correspondence is is clear and grammatically correct English.
you want to demonstrate that at the very least you are a competant teacher.
Even writing "wanna" is not a good sign, and yes this actually does matter in all that you write.

First you don't need to worry about any of this information or ghost stories from these guys above.

 

Yes, you can leave, but if you wanna makesure there are no problems, than makesure you finished filing your taxes and paying anything you owe, even if you don't you will still be allowed to leave.

Ask a Chinese friend to help you download this Chinese Tax app: 个人所得税

 

Go to the tax office if you still have time or maybe you did this already or they did it for you and setup your account and filing takes only 5 minutes or less, its soooo easy.

 

Taxes are the only reason anyone is stopped from leaving. Not because you want to leave your job.
