Q: School says working while visa is being processed is ok?

The school is telling me that working while  my visa is being processed is fine, They have told me not worry about the PSB coming to the school because my visa is being processed so i have no need to worry?

My spidey sense's are a tingle and think that this is not true?

Yes, it is against Chinese law working and receiving salary without Working permit and proper visa (Z ---> Residence permit).

School is telling you, 'police won't come, while you'll rob the Bank', butt...you never know, do you?!

Last year, I worked (and received pay) half a year with F visa, which was extended twice. Agency said at first, I must work with F only for 30 days, till they don't get Working permit out of Government. 1 month became 6 months, and I had only one honest choice: 'leave China, and enter with Z', but School told me: 'Don't worry!'.

I ended up picking up Z visa in Hong Kong, and returning to China, without consequences for working with F.

You could check, if your School is authorized to hire foreigners:

I'd urge extreme caution.

Some places approve this. It varies from place to place, but I would not recommend going to the school without the proper visa, even though I did it. My local PSB approved my work on an X visa while the Z visa processed, and I also got permission from my Chinese college to work here while the visa processed.

Some places can even switch in the country (I heard Shandong will do this). Most of the others will send you back to your home country. The school has to pay for that.

They are insisting that i must go to the police station and registry there, and this seems a tad strange going to the police station and registry my self and telling the police where and when i am/plan to break the law,

I only have a few days left so this seems very strange, if i go to the police station they will check my visa right? and when they start they clamp down they will just be able to pop in to the school and pick me up?

Max, if indeed your paperwork has been turned in and the PSB has your passport and you hold a Foreign Expert Certificate, you may indeed be working during this time, if your Foreign Expert Certificate is being processed and the PSB has not received your documents but you are on a valid resident visa, that is also ok, if you are on a Z visa, meaning you already possess your Foreign Expert Certificate, this is also ok as long as you have been to the PSB to begin processing your paperwork, if you are on any other visa, call BS.

maxwell888:

No paper work at all, no FEC, No Z and anything else that i was promised is still to magicly  appear !!!

so is it best to stay away from the police station ?

Max, get your passport and run. You are able to do a visa run to Hong Kong for your Z visa, if this is what they are doing, ok, but your current visa puts you into the grey area, depends on their connections.

i am outta of here at the end of this week, i would leave sooner but they seem to think that the contract is still legally binding on my side but refuse to acknowledge that they haven't done any thing on their side i.e Z visa as promised,

clearly my own fault for trusting them and believing that they would do as they say, should of stayed away but i kinda wanted to stay in china,

i was hoping that they would not be full of BS,

A few fellow teachers i know at different schools/training centers have been told the same story that if its being processed it is ok, one of my friends got told by their training center that they have special licensing from the government and they are the only school in SZ that can employ people on L & F visa's !!!!! if your going lie you might as well make a big one i guess,

icnif77:

Contract is not binding (legal), if you don't have correct visa/ Residence permit, and all paperwork behind. That is my own, last year's experience. You can walk away anytime you want.

School will tell you anything, just to keep you working there.

im not too familiar on the procedure, correct me if im wrong but your visa would start on the day that it was handed in right, just like on the tourist visa it would start on the day you processed the application, do they not give you some sort of document while you wait for it to be collected?? i mean what what if you happened to live in guangzhou and the police stopped you for a passport check. anyways someone from the school should accompany  you to the police station to register

maxwell888:

When i did the process before i did it from back home, and the school sent me a Alien employment certificate  and then i took that to the chinese embassy and got a the Z visa valid for 30 days on arrival in china, then you and the school get 30 days to go to the police station and get the Residence permit sorted, which took around 2 months,

Also i think i haven't explained my self correctly above about my concern with the police station,

yes the school would send some body with me to the police station,

but my concern is that the last 2 Work permits i had i needed to go to the police station  and it was a long process and the police checked my passport and visa's for a long time, so my thoughts are that i should stay away from the police station as they will check my passport and visa and see that i do not have the legal visa, and the police will know (if they dont already and they dont arrest me there and then ) where i will be and where to come collect me if and when they take part in the clamp down that starts on the 1st july?
