Q: A second child in China?

We have one daughter born in the UK 4 years old.Are second baby due in May this year,my wife is Chinese im UK citizen,anyone been through the process in China just keep being told go this department phone here its not allowed.

If you lived in China, then you may have some problem when the child is of age to go to school, but the worst will be to pay a fine and problem resolved.  If you live outside of China, you do not have a thing to worry about, most probably the new born will have a UK passport anyway.  You will have to face the problem after the baby is born, when the baby will be added to your wife's hukou booklet.

And I do not know the following from personal experience but from word of mouth, the fine should be equal to either one month's salary or one year's salary, I forgot what my friends told me since it was maybe 8 years ago.

Since your first child is a UK citizen, she doesn't count towards the 1 child policy.  And if you have your second child registered as a UK citizen, that child won't count either.  Basically, foreigners and their spouses can have as many children as they like as long as they register them as citizens of that foreign country.

When it comes time to send them to school, you shouldn't have any problems at all.  You may need to pay higher tuitions though since your children will not be "Chinese".

As ExPat said, you may have to pay estra (or a higher fee) when time for school arrives. Their negative to decide what to do comes from the fact that China does not recognize dual nationalities. And they assume that if one of the parents is a foreigner, the kid will be registered also as a foreigner. Keep on asking for the birth certificate after baby is born, you will eventually get it, and get the baby also added to your wife'a hukou booklet, that will result in lower school fees later on. Just do not mention to anyone that you will register the baby's birth with your Embassy too.

I have twin 4 year olds that were born here. There wasn't a problem at all having them. The only issue was that we needed to have them registered with our consulate within 90 days of giving birth.

I had an Irish colleague who had three kids. One born in Ireland and the other two born in China (not twins) and he had no trouble at all. And his wife was British born Chinese who could speak cantonese but not mandarin.

If one parent is foreign you can have as many kids as you want.
