Q: Risks of teaching without a FEC?

a friend of mine is working as an English teacher for kids. The school was unable to apply for a FEC and just provided him with a working visa, but for a sales job, 

 

What are the risks if he get checked?

A fine, deportation & blacklisted from re-entry. 

 

Id guess though that he's in a better position than working on a business or tourist visa.

I thought the FEC and the z were tied together.

If he got a Z visa for a sales job he would still neeed a work permit. Thats a brown book.

Mine is dark blue (ET). Maybe FEC differs in colors for different jobs, but something is 'shady' in OP's post.

Either Z get turned to RPermit with FEC, or Z expires 30-day after entry to China. Chinese law, and 'novelty' is 'FEC must be obtained first, then RP'.

Yeah, my book is brown, but its a work permit, not an FEC. I think its issued from a different department.

Probably different deps.! FT's original WP is needed at Z application. Piece of paper (A4) with Chinese red stamp on the bottom.

1) you need official documentation to get the 'Z' visa.

2) within 15 days of arrival I had to apply for the FEC and RP - submitting passport to PSB

3) RP issued and FEC supplied as well.

 

your friend may not be legally employed if these steps have not been taken - should take it up with SAFEA immediately.

or it could be a case of a lazy employer BSing

If you friend has not got the RP in his passport after 30 days - leave: not legally employed.

I'm a bit confused now (which is not difficult!)

 

I've got an Alien Employment Licence (work permit) & residence visa. I'm an Engineer. Had a Z visa once 4 years ago to get the first WP & RP

 

I thought teachers needed an FEC to get an RP? My understanding was that an FEC was a teaching version of a WP?

 

Now to the OP. If the school is unable to apply for an FEC for him it may be evade they aren't licenced to employ foreigners. So which company name is on the WP for this "Sales job"?

Your friend needs to be careful then. There is a risk of spot checks at the school & the trade company. Either of which could catch him out. Hope it works out for him wth no problems.

I am going through this process now.  You first need a FEC before you can get a work permit.  Both are required for a Z visa, which is what you need to enter China to work.  After you arrive in China, you have to apply for a RP.

Officially the local authorities can come anytime to check your visa and FEC and you are expected to always carry them with you.

If you don't have the proper visa you can get jailed then deported and blacklisted from returning to China for up to 10 years.

In the real world of the real life they extremely rarely conduct any checking especially outside first tier cities. Even so they don't seem to give a damn whether your Z visa is for teaching or managing or sales as long you have one.

And your employer can still bribe them.

There has been some raids onto big firms (EF, Wall Street English, ...) in 2012 as part of the new government's propaganda machine "look, we take care of those illegal scums" but it stopped now probably until the next presidency in 2022.

I have been here for nearly 11 years in Shenzhen and I still haven't met or actually heard of this happening to anyone from the top 5 countries.  I've only heard about this happening to 3rd world guys, I'm not try to discriminate but hey its the only thing I've seen in China. I've seen friends from the top 5 countries get caught but they were ok and released and sometimes had to pull out some cash and maybe 2% were blacklist but they still made it back and are fine today. So your message here is a little funny for experienced guys, will the visa apocalypse hit next?

Yep I know, German, in 8 years I have never been checked once. Same for my friends from the top 5 countries or the big 5 English speaking countries. But there has been cases of deportations in 2012 and early 2013 when Xi came to power, it was covered by the medias so obviously it was to show that "we do take care of illegal immigrants", nothing since then.
